This document legally transfers all of Buyer A’s rights to Buyer B. It also releases Buyer A (“Assignor”) from any liability or obligation and substitutes Buyer B (“Assignee”) in their place.
Even though your buyers are lined up and waiting, and you’ve lined up plenty of capital from private lenders, you still need to find inventory that works. That will typically be some form of distressed property or a property being sold by a motivated seller. Build those lists, master connecting with them and negotiating, and you’ll have a complete, smooth cycle of profit making.

Assignment is a tool in contract law…I had several RE lawyer consultations before buying that first property through an assignment contract. One talked my ear off about erroneous highly unlikely scenarios, HOURS OF TALKING. So that lawyer talked herself right out of a job. Two other prominent RE lawyers in Philly promised to send engagements letters to review the contracts and never did…On follow up it was apparent they never intended to do so. While not necessarily a “property type,” notes can be bought, sold, mortgaged, and traded just like the properties they represent.  Often times an owner of a property may choose to offer financing and “carry the mortgage”. In this case, a “note” would be created which spells out the terms of the contract. For example, an apartment owner decides to sell his property for one million dollars. He offers to carry the full note and the new buyer will make payments of 8% per year for thirty years, until the full one-million dollars is paid off. If that owner suddenly needed to get the full balance of the loan, he might choose to sell that mortgage to a “note buyer” for a discount. That note buyer will then begin collecting the monthly payments and decide if they will keep the note or try to sell it for profit.

Additionally, your personal risk is contingent on the way your contract is written. So depending on how much you put down in escrow – which, again, could have been as low as $10 – you might have to repay your seller if you are unable to find a buyer. It is best to have potential buyers lined up before even making an offer to the seller. That way, your risk of losing money is substantially lessened. While owing your seller a measly $10 doesn’t sound like a lot, it has a bigger affect on your reputation. If word gets out that you are negatively affecting homeowners, future buyers will be less likely to want to do business with you.

You can then put the data together and use it that way to delete all the properties that are owner occupied (where the property address and mailing address match).

great post Robert! I feel like the author has a chip on his shoulder. Most new investors assign contracts BECAUSE THEY DONT HAVE MONEY, YET. There is usually no intention of messing up the seller, they have every intention of seeing the sale through via an investor flipper. Now, I believe assigners should be as up front with the seller as possible and tell them that there may be a slight chance the sale wont go thru and in that case, reward the seller with keeping the earnest money or a little more..But trashing the whole method of assigning because you had a bad experience isnt an objective opinion

Well, a lot depends on your Broker.  You have to talk to your broker and let them know that you want to flip houses.  Some brokers will not let you, and other brokers will let you as long as you disclose that you’re a Realtor.
On the buyer side I would have a website that captures contact info from buyers and fellow investors in your local area. Your buyer website is where you can send people you network with, craigslist investors, etc so that you have their info for future properties you acquire that maybe you are wholesaling or that maybe you need funding for. You can turn to your buyers list and take the necessary actions to get a deal done with their help.

I have my main group of buyers that buy most of my properties so it doesn’t usually take more than a day or two to have the wholesale deal assigned (as I try to assign the contract most of the time). If you have a decent deal, but not a lot of buyers on your buyers list, it may take you a couple weeks to find a buyer. This means you must work immediately, after receipting the contract at your title company, on finding a buyer and don’t stop until you find one. The good news is that once you have a deal to push, you can grow your buyers list quickly as you advertise the deal and have buyers call you about it.
Never use an option contract when wholesaling real estate in Oklahoma. The Oklahoma Real Estate Commission is unofficially operating under the understanding that option contracts do not give the purchaser an ownership interest in real estate at the time the contract is entered. If you are using an option contract you are likely violating the Oklahoma Real Estate License Code and exposing yourself to the risks associated with that choice.

The money a wholesaler makes on each deal varies greatly depending on the wholesaler and the property. Some wholesalers make $2,000 on each deal, others $5,000, and some more than $10,000 on each deal. I know multiple wholesalers who are doing more than five wholesale deals a month and averaging over $5,000 per deal. You can definitely make good money wholesaling, but to do many deals you have to spend money on marketing and have a great system. There will be many calls coming in from possible sellers and you have to be able to talk to those sellers quickly, determine if the price is right, get the home under contract, and find a buyer.

Wholesalers may also buy houses from the MLS. When buying from the MLS a wholesaler may have to use a real estate agent and they may have to use a double closing. Many MLS properties like HUD homes and REOs cannot be bought with assignable contracts. A double close is when the title company will use the end investors cash to purchase the home from the original seller. This can be tricky, but if done right the wholesaler will never use his own money. MLS deals are typically harder to wholesale, because more people know about them and many cash investors could buy those houses without a wholesaler. If the wholesaler can negotiate well below asking price or act quickly to get awesome deals it is possible to wholesale from the MLS.
