Would you feel…”helped?” Yea right. Some of the seller calls I’ve watched online make my stomach turn. There’s no question why wholesaling is viewed as the black dog of real estate. If you’re going to assign, do it with 200% transparency from start to finish, all numbers disclosed, and above all think about what it really means to serve the interests of homeowners, above reproach. Wholesalers may also buy houses from the MLS. When buying from the MLS a wholesaler may have to use a real estate agent and they may have to use a double closing. Many MLS properties like HUD homes and REOs cannot be bought with assignable contracts. A double close is when the title company will use the end investors cash to purchase the home from the original seller. This can be tricky, but if done right the wholesaler will never use his own money. MLS deals are typically harder to wholesale, because more people know about them and many cash investors could buy those houses without a wholesaler. If the wholesaler can negotiate well below asking price or act quickly to get awesome deals it is possible to wholesale from the MLS.

U.S. In that case, the 10th Circuit was reviewing the question of whether a real estate purchaser was able to take a demolition loss on his tax return. The answer to the question came down to the moment the property was purchased. There were two competing ideas of when the real estate was purchased. The first date considered was the date the Contract for Sale of Real Estate was entered. The second date considered was the date the purchaser received the warranty deed and took possession of the real estate. The 10th Circuit stated, “The commonly accepted definition of “purchased” is a binding agreement to pay an agreed price. It may be a complete or an incomplete transaction in terms of tender, but it must be binding and enforceable.”[iv] Ultimately the 10th Circuit determined that the real estate was purchased on the date the contract was signed.
Ok ways around earnest money….there is no strategic way around this. I’ve learned that in most cases if you do not mention EM you do not have to add it to the contract. You can have the EM as low as you can possibly can. Remember everything is negotiable and use that as a tool to negotiate with.

Some wholesalers will never do a deal and others do hundreds of deals a year. The money a wholesaler makes on each deal varies greatly depending on the wholesaler and the property. Some wholesalers make $2,000 on each deal, others $5,000, and some more than $10,000 on each deal. I know multiple wholesalers who are doing more than five wholesale deals a month and averaging over $5,000 per deal. You can definitely make good money wholesaling, but to do many deals you have to spend money on marketing and have a great system. There will be many calls coming in from possible sellers and you have to be able to talk to those sellers quickly, determine if the price is right, get the home under contract, and find a buyer.

An equity REIT invests in properties, a mortgage REIT invests in mortgages, and a hybrid is the mixture of the two. All three typically offer high yields – basically you get paid back from the interest others are paying on their mortgages.
All three of these professionals can be found through referrals, online searches and from recommendations from a real estate wholesaling group. Another real estate wholesaler will be able to tell you who he recommends using in your area too.
Brett I’m sorry, but articles like this that are laced with “Me”, “I”, ” in my opinion” are typically written by the uninformed. As a fellow broker I would caution you in publishing articles where it appears your giving legal advice, and incorrect advice to boot. Your brokers license does not permit you to give legal advice. I have been fortunate to have been in the game long enough to ride two giant waves of appreciation and inflation. There is always something wrong on the inspection that the seller has to fix. The buyers financing always has issues. The appraisal usually will come in short and the seller has to lower his price. Termite reports, survey, land encumbrances, etc. Its a pain and the sellers dont want to go through it.

Only $50,000!” When prospective purchasers call on the ad or enter into the contracting phase, the wholesaler is not forthcoming with the fact that he or she only has an interest in the property via an earnest money contract with a seller. Additionally, the advertisement offers the underlying real property for sale which clearly requires a real estate license issued by the Texas Real Estate Commission. Tex. Occ. Code § 1101.351 (West 2017).

MBSs and MICs are even a further step removed, as they invest in private mortgages rather than the underlying properties. MICs are different from MBSs in that they hold entire mortgages and pass on the interest from payments to investors, rather than securitizing the interest streams independent of the original mortgage. Still, both are not so much real estate investments as they are debt investments.

There is usually no intention of messing up the seller, they have every intention of seeing the sale through via an investor flipper. Now, I believe assigners should be as up front with the seller as possible and tell them that there may be a slight chance the sale wont go thru and in that case, reward the seller with keeping the earnest money or a little more..But trashing the whole method of assigning because you had a bad experience isnt an objective opinion

We then ran 15,000 Monte Carlo simulations with historic data. The result is that the long term strategy produces a 2% higher IRR and losses occur 4 times less often than with a purely opportunistic strategy. (see my answer to “What’s you investment style” for more details).
While many properties publicly listed on the MLS may seem overpriced agents can have access to off-market properties, additional information on how motivated sellers are to negotiate, and can market for deals on your behalf.
There are a variety of different types of real estate investing, each marked by different phases of development, so it is important to understand the timeline of the potential project, its development stage, and how that will affect your investment.
Ideally, a wholesaler will steer clear of engaging in real estate brokerage and will fully disclose that he or she is only assigning the contract to the assignee with the expectation that the assignee will now assume all of the contractual obligations and rights. Now for selling 4 houses that might not seem like a huge amount of money, but we had already done most of the leg work on these properties, had already paid for marketing, and we didn’t have to come up with the capital to finance them or worry about the tenants, rehab etc.  Basically there was zero risk for us and no need to invest our own capital, so we were more than happy to collect $22,000 on a group of houses we would otherwise have never purchased.

I can also see it as possibly being a path to start investing. I would like to find distressed FSBO properties in a low cost area(Los Angeles Mobile Parks are gouging their poor residents) and purchase and either flip or hold as an income property. But I’m getting way ahead of myself. I just wanted to give you an idea of where my head is at for this. I would like to start as a wholesaler in mobile homes. I can see how this concept can be applied. So my questions are as follows…It seems that the legal ramifications come if you are doing this frequently or in bulks. For example, If you have a deal for like 5 homes at one time, or if you are doing 5-10 deals a month. Does this sound about right? (what makes this different than if my neighbor is selling their house, I tell them my aunt in another city is moving and would buy the house, I just act as the go between. This is a one time deal and they gave me a bit of money for my time and travel?) I am truly fresh out the gate so I would only want to do at most 2-3 deals a month. That would be insane right now, lol. How do you receive payment? I tried working this out a million different ways but the best I could work out was as follows…I make an EMD with seller(contract), contact buyer from list, sell(contract) new buyer(collect payment to me as seller)close/transfer?,cash(remove my payment), contact, pay and close with original seller, collect my EDM back. Does this sound right? Also do you use the title company on the property, a third party, an attorney, or broker for holding EDM, contracts, closing? I was disappointed when you got to the part about figuring ARV and did not mention resourcing an appraiser. Too many myths and misconceptions out there about appraisers, including how much it might cost – maybe this is why you failed to mention them? A realtor might be slow to help because as you said, what’s in it for them? Also, some realtors have lists of buyers ready to go too, so you might be alerting your competition to a good deal. Appraisers are only in it for the fee and will be eager to help out. An ARV appraisal could be done for as little as $50 in some cases. Better yet, you might be able to set up a retainer agreement and then call upon the appraiser for multiple deals whenever you need them. Yes, this post is self serving, but it is also the truth!!!

A typical wholesaler might use postcards sent to absentee owners (owners who don’t live in the home) to try to buy the home. Absentee owners are sometimes more motivated because they don’t live in the house and may have bad tenants or no tenants. The wholesaler will negotiate a price with the seller knowing what his buyers will pay. The wholesaler will use a contract that can be assigned and then collect an assignment fee at closing. Real estate agents are usually not involved, but can be. The difference between what the wholesaler agreed to pay the seller and what the investor/end buyer agrees to buy the house for is what the wholesaler makes. Wholesalers may make a couple thousand dollars per deal or much more. I know multiple wholesalers that have made more than $20,000 on one deal.
The closing, or settlement as it is also known, will take place at the title company’s office and will last about 90 minutes. All parties will come together and the deed will be transferred to the new owner. Once this is done, it will be the completion of a wholesale deal.

A real estate agent has gone through the licensing process in the state they are selling real estate. Real estate agents also must have their license hung with a real estate broker or be brokers themselves. A Realtor must do everything a real estate agent must do and belong to the National Association of Realtors (NAR). NAR requires members to abide by a code of ethics and belong to a local board of Realtors. The income level for Realtors and real estate agents is different because more Realtors work full-time and take their job more seriously. That does not mean every Realtor is better than every real estate agent is, but the averages do show that Realtors make more money. Equipped with an end buyer in place, and the money you need to close, it’s time to get out there, find the motivated sellers and undervalued properties, and secure them with a contract. These deals can come from almost anywhere. They can be bank owned REOs, bulk deals from funds, underpriced deals from the MLS, foreclosure auctions, FSBOs, deals from other real estate investors, probate property and estates, or simply homes you uncover marketing to those with a high motivation and need to sell swiftly. Create a network of referral agents, a marketing campaign, put property scouts out there to work for you, and obtain lists of motivated sellers using smart software.

Typically the assignment fee is detailed on the Assignment Agreement (this is what documents the sale of the original paper to the new buyer). I don’t typically use an Option Agreement when I wholesale, because with the way I do it, it’s an unnecessary extra piece of paper that tends to clutter up the process. I just use a Purchase Agreement and an Assignment Agreement – hand it off to my title company and that’s it.

I did not say that wholesalers have to buy the house, however other BP wholesalers have said that wholesalers need to be prepared in case they do need to buy the house themselves in order to fulfill the contract to the seller. This situation never happens to an agent.

You would also have to get it notarized in order for it to be recorded (it’s kind of a hassle, which is why some don’t bother with it). You would typically take it to the county yourself, or mail it to the County Recorder along with a check to pay for the recording fee. Again, if you do go through these options, it will cloud the title for however long the date range is listed on the memorandum. i.e. – if the memorandum states that the Purchase and Sale Agreement expires on X date (6 months from today), that cloud will stay on the title for 6 months.
